2 Chinese Companies to List on ASX

Tindall Gask Bentley have recently been retained by 2 Chinese based companies to advise on their listing upon the Australian Securities Exchange. Gansu Dunhuang Oasis Animal Husbandry Limited and China Rongtai International Holdings Limited will follow TGB’s historic listing in 2007 of Tianwaitian (TWT), which became the first company based wholly in mainland China to list on the Australian Securities Exchange.

Gansu Dunhuang Oasis Animal Husbandry Ltd is an agricultural business involved in invitro technology for sheep embryos and China Rongtai International Holdings Ltd is an e-commerce steel logistic business. TGB partner Brendan Connell has been acting on behalf of Chinese clients since 2002 in the areas of initial public offerings, capital raising, investment in the Australian mining and resources sector and general commercial advice.

TGB Bus Campaign

We have launched an innovative new campaign to direct people to the TGB website tgb.com.au. New advertisements now appear on the back of Adelaide metropolitan buses. These advertisements highlight TGB and our practice areas of injuries, workers compensation, commercial, family and wills & estates.

Channel 9 Melbourne Cup Luncheon

TGB were the major sponsor of the Channel 9 Melbourne Cup Luncheon. The event hosted by Tony Pilkington attracted 420 guests to the Stamford Grand. Over $20,000 was raised from the event which will support a number of charities including Paraquad SA, with whom TGB have a longstanding relationship.

Sam Hooper Stars in The Apprentice Australia

You may have seen him in your lounge room as the youngest contestant on Channel 9’s “The Apprentice Australia”. Sam Hooper has been working at TGB for the past 18 months as administrative support. Sam is currently studying second year Law/Commerce at Adelaide University and was recently given the opportunity of a lifetime to travel to Sydney to take part in the production of the show. Change in WorkCover Policy on Death Claims

The WorkCover Corporation has just made an important change to their policy on how contested death claims are to be resolved. Section 44 of the Workers Rehabilitation and Compensation Act 1986 allows a dependent spouse or domestic partner to claim a lump sum payment of compensation where a worker dies as a result of a compensable disability. Dependent spouses, domestic partners and dependent children of deceased workers are also entitled to claim weekly income maintenance payments based on the extent of their financial dependency on the deceased worker as at the worker’s date of death. Workers Compensation Changes - The New Section 43

Effective 1 April 2009, significant changes to the way a worker’s entitlements to lump sum compensation for permanent disability are assessed, took effect. Since the changes, assessments of permanent disability are now only able to be made by Accredited Assessors who have been trained under the AMA Guides to the Evaluation of Permanent Impairment, Fifth Edition. Furthermore, the assessments that they make are now of “whole person impairment” (WPI). To view a brief overview of the changes to lump sum compensation legislation click here. Holding Your Liquor Licence

A recently published decision of Justice Brereton of the Supreme Court of New South Wales in McHugh Holdings Pty Ltd v Newtown Colonial Hotel Pty Ltd. has highlighted the need for careful lease drafting to secure a lessee’s liquor licence.

The case is a useful one as it addresses the legal status of the liquor licence after the lessee has ceased to occupy the premises. These issues should be covered in the lease. In some situations a lessee may have acquired a transfer of the lessor’s liquor licence without consideration to be able to use the premises. Then it is fair that the lessor should be able to reclaim the licence when the lease comes to an end. If the lessee acquires a liquor licence for substantial consideration from the lessor, or from the former occupant of the premises, then it is fair that ownership and control of the licence remain with the lessee. The case also highlights the potential problems in trying to impose restraints of trade provisions in leases. To view the full article click here . John Swift Joins the Wills & Estates Team

John Swift has recently joined the Wills and Estates Team, following many years working as an Accredited Specialist in family law. He specialises in drafting Wills, Enduring Powers of Attorney, and Enduring Guardians. John has a particular interest in the preparation of highly involved Testamentary Trusts and “Blended Family” Wills. John’s masterly drafting of straightforward plans for the distribution of property and assets means clients can rest assured that their wishes will be met, in every detail. TGB Recognised as Gold Alliance Firm

PARAQUAD SA 2009 Safe Driving Campaign

TGB are proud to be a Road Safety Partner with Paraquad SA. The Paraquad SA 2009 Safe Driving Campaign aims to promote safe driving practices to young people, who account for 28% of all road fatalities and 27% of serious injuries. It also encourages parents to become safer drivers and role models for their children. Parent-Young Person Safe Driving Agreements ask for commitments from parent(s) as well as from their children.
